Many form contracts are only included in digital form and are only presented to a user as a click that the user must “accept”. Since the user can only see the agreement after acquiring the software, these documents can be contracts of liability. As further described in the Atlassian Marketplace Terms of Service, Atlassian Marketplace lists a large number of applications that can be used with the software, including Atlassian applications and third-party applications. Atlassian Software Applications are considered “Software” for the purposes of this Agreement (unless otherwise specified by Atlassian on the Atlassian Marketplace). Third-party applications are not software and remain subject to the applicable terms of the provider. Atlassian may enable interoperability of the software with third-party applications in accordance with Section 4.1 (Third-Party Products). The terms “Applications”, “Atlassian Apps”, “Third Party Applications”, “Suppliers” and “Supplier Terms” are defined in the Atlassian Marketplace Terms of Use, which are a separate agreement governing the use of the Atlassian Marketplace. Throughout the service period (or, in some cases, only at the end), the service provider must provide the customer with what the customer expected, i.e. one or more “services”.
